RE: HOA Responses to Questions and Issues Raised

The HOA Board has received a number of questions, comments and statements from HOA members regarding the upcoming HOA annual meeting, the proposed By-laws amendment and other related issues. The Board is providing the following responses in an effort to provide HOA members with additional information regarding the issues and questions raised.

RE: HOA Member Comments on Proposed By-laws Amendment

As with any important issue, there are multiple views and opinions. The HOA has received comments in support of, and opposition to, the proposed by-laws amendment.

All owners present at the annual meeting will have the opportunity to speak in for or against, the proposed by-laws amendment, prior to the vote tally on the amendment. Any owner who wishes will have the opportunity to change their vote, even if they mailed in a ballot, after the comment period and before the vote tally.

We hope that you will be able to attend the meeting. However, if you can’t, we are also collecting written comments from members and will make those available at the meeting and on the HOA website.

If you would like to have your statement included in the written and website comments, which is an option even if you plan to the attend the meeting, please let us know and we will make sure it is included. We will be adding comments to the website as we receive them. Written comments should be sent to: tellyourboard@bellabeach.org

RE: Write-in candidate for Board of Directors Election

RE: Error in the additional information section of the HOA Annual meeting packet

After the February 29th mailing went out, an error was discovered on page 3 of the additional information pertaining to the proposed by-law amendment. A correction letter has been mailed to all HOA members. A copy of the letter is available in PDF format.

To: Bella Beach Homeowners
Re: Bella Beach Homeowners' Association ("Bella Beach") Annual Meeting

Dear Bella Beach Member:

At the Annual Meeting of the members of Bella Beach, Lot Owners will elect three (3) directors to the Bella Beach Board and will vote on a proposed Amendment to the Bella Beach By laws. In order to conduct the Annual Meeting, a quorum consisting of at least forty percent (40%) of all Lot Owners must be present in person or by proxy. Owners who collectively own at least 36 lots establish a quorum for Bella Beach.

The Annual Meeting is scheduled for Saturday, April 5, 2008 at 10:30 a.m. At the meeting, Lot Owners will vote to elect three (3) new directors to replace Pat Corcoran, Dave Loverink and Al Watkins as their terms have expired. The current nominees for these positions are Joe Brewer, Dat Nguyen, and Casey Roloff.

Lot Owners will also vote on a proposed By law amendment concerning property management companies and rental agencies doing business in Bella Beach.

It is very important that you fill out and return both the ballot and proxy as soon as possible, but in no event later than April 4, 2008. Bella Beach must obtain a quorum to conduct the meeting and the election. Please fill out and mail the ballot and the proxy even if you plan to attend the meeting so we are sure to achieve a quorum. If you attend the meeting in person, you may ask for the return of your ballot and proxy at the meeting and re-vote at that time.

In the proxy you may:
1. At minimum, allow the use of your proxy to establish a quorum.
2. Optionally, if you choose not to mail a ballot, you may also direct a person you designate as your proxy to cast your ballot in accordance with your instruction.
